1. Introduction

1.1. This Privacy Policy applies to all users of our Website and forms part of our website terms and conditions.

1.2. The purpose of this Privacy Policy is to set out how, why and when Canine and Co will collect and process your Personal Information so as to comply with the Protection of Personal Information Act 4 of 2013 (“POPI”).

1.3. It is important that you read this Privacy Policy together with our other terms and conditions, privacy notices or policies we may provide from time to time when we collect or use your Personal Information.

1.4. We respect your privacy and take the protection of Personal Information very seriously.

1.5. By using our website, you agree to the processing of your Personal Information as set out in this Privacy Policy.

1.6. In this Privacy Policy, the terms “Personal Information”, and “process/processing” bear the same meanings as set out in POPI.

1.7. If you are below the age of 18 years, you must always get permission from your parent or guardian before you use our website or give us your Personal Information. We may check that your parent or guardian has given you such permission. If we are not able to verify such permission or if a parent or guardian confirms that you do not have their permission, you may not use our website.

2. Personal information we collect

2.1. When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the website, and information about how you interact with the website. 2.3. Additionally, when registering on our website and making a purchase or attempting to register or make a purchase through the Site, we collect certain information from you, which may include your:

2.3.1. Name and surname;
2.3.2. Email address;
2.3.3. Physical address;
2.3.4. Billing address;
2.3.5. Gender;
2.3.6. Mobile phone number;
2.3.7. Online identifiers;
2.3.8. Date of birth; and/or
2.3.9. Identification number.


We refer to this information as “Order Information”.

2.4. When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

3. How do we use your personal information?

3.1. We use the Order Information that we collect to fulfil any orders placed through the Site (including processing your order, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

3.1.2. Verify your identity;
3.1.3. Create a user account for you;
3.1.4. Enter into a contract with you;

4.1. We may from time to time share your Personal Information with third parties to enable us to attend to our contractual obligations and for the further purposes described above. Third parties may include the following groups of people:

4.1.1. our employees, and/or third party service providers in order to enable them to assist us to interact with you via our website for the marketing, ordering or delivery of goods;
4.1.2. law enforcement, government officials, fraud detection agencies or other third parties when the disclosure of Personal Information is necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability or financial loss, to report or support the investigation into suspected illegal activity;
4.1.3. third parties in the event of any reorganisation, merger, consolation, sale, joint venture, or other disposition of any or all of our assets;
4.1.4. our service providers (under contract with us and who are subject to the same or similar legal requirements) who help with parts of our business operations (our contracts dictate that these service providers may only use your Personal Information in connection with the services they perform for us and not for their own benefit or any other purpose, and must treat such information as confidential information);
4.1.5. our suppliers and manufacturers, where applicable, in order for them to liaise directly with you regarding any goods you have purchased or for any other purpose which may require their involvement.

4.4. We will, insofar as reasonably possible, notify you if we have been required to share personal information in line with the above.

5. Data retention

5.1. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. We keep a record of your Personal Information for so long as:

5.1.1. we need it to provide our products or services to you.
5.1.2. it is required or allowed by law and is in line with our internal retention policies.
5.1.3. it is necessary to uphold the contract between you and us.
5.1.4. you have agreed to us keeping your Personal Information subject to your request for us to stop processing your Personal Information.

5.2. We will retain your Personal Information for as long as is necessary to achieve the purpose for which this information was collected or subsequently processed. If your Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires but we will stop using it for the purpose with a shorter period once that period expires.

5.3. By accessing and using the Platform, you consent to us retaining records of your Personal Information for no longer than may be necessary to achieve the purpose for which the information was initially collected or subsequently processed.

6. Links to other websites

6.1. Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over the website you have opened. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement.

6.2. You should exercise caution and look at the privacy statement applicable to the

7. Securing your personal information

7.1. We secure the integrity and confidentiality of your Personal Information in our possession or under our control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of Personal Information; and unlawful access to or processing of Personal Information.

7.2. In order to implement and maintain such measures, we have in place policies, controls and related processes, which are reviewed and updated on a regular basis. These measures include:

7.2.1. Physical, technical and network security;
7.2.2. Access controls and monitoring of access;
7.2.3. Secure storage, destruction and encryption of records of Personal Information;
7.2.4. Personal Information breach reporting and remediation; and
7.2.5. Conclusion of transaction agreements with third parties which include confidentiality obligations being placed on third parties who process Personal Information as part of rendering services.

8. The rights of the Users

Having provided adequate proof of your identity, you have the right to:

8.1. In accordance with the provisions of POPI, following sharing your information, you have the following rights to (not exhaustive):

8.1.1. view, correct and/or amend your Personal Information we process;
8.1.2. request a record or description of your Personal Information (within reason);
8.1.3. request to have your Personal Information corrected, destroyed or deleted. Please note that you can stop being a registered user by cancelling your account. Further, if information is required to be destroyed or deleted which is required for Canine and Co to render its obligations, we will be entitled to suspend your use of the website;
8.1.4. Submit a complaint to the Information Regulator.

9. HOW TO LODGE A COMPLAINT WITH THE INFORMATION REGULATOR
